These Terms & Conditions (“Terms”) govern your use of our website and any booking, reservation or purchase you make with Asia Explore JSC (the “Company”). By accessing or using our website or making a booking, you agree to be bound by these Terms. If you do not agree, please do not use the website or make any booking.

1. Definitions

  • “Customer”, “you”, or “your” means the person making the booking, or any person on whose behalf a booking is made.
  • “Booking” means any reservation, purchase or contract you enter into with us for travel, holiday, tour, accommodation, transfer, activity or other services.
  • “Services” means all travel-related services provided by us or our suppliers in connection with your booking.
  • “Supplier” means any third-party providing transportation, accommodation, excursions, transfers, guides or other components of the Services.

2. Contract between You and Us

2.1 A binding contract between you and Asia Explore JSC comes into existence when we issue a written confirmation (including e-mail) to you of your booking and we receive any required deposit or full payment (as applicable).
2.2 The person making the booking must be at least 18 years of age and have the authority to act for all persons named on the booking.
2.3 The lead name on the booking is responsible for making all payments due, supplying all traveller information, ensuring all travellers are aware of these Terms and any additional conditions, and for the behaviour of all on the booking.

3. Booking & Payment

3.1 Bookings must be made using our booking form or through e mail as well as over the phone in case of any urgent emergency bookings, and you must provide correct, full and truthful information.
3.2 A deposit may be required at the time of booking; the balance is due by a specified date (which will be indicated in your confirmation). If full payment is not received by the due date, we may treat this as your cancellation and apply the cancellation charges (see Clause 8).
3.3 All payments must be made in the currency specified by us, via the method accepted by us (bank transfer, credit card, etc.). Any bank or transaction fees are your responsibility.
3.4 Prices shown are subject to availability, currency fluctuations, costs imposed by suppliers and changes in tax/surcharges. We reserve the right to adjust prices up to the time of payment (see Clause 4).

4. Alterations to Price or Services

4.1 We endeavour to ensure all details of services are correct at the time of publication, but errors may occur. We reserve the right to correct any error or change published details without prior notice.
4.2 Before your booking is confirmed with full payment, we may make modifications to price or services. We will inform you of any increased cost or alteration. You may either accept the change or cancel the booking and obtain a full refund of monies paid.
4.3 After confirmation, we may only make changes in accordance with Clause 7 (Changes/Cancellations by us) or Clause 9 (Changes by you).

5. Your Obligations & Travel Documents

5.1 You must check all, and ensure accuracy of, your booking confirmation and all documentation (dates, names, services) immediately upon receipt and notify us without delay if any information is incorrect.
5.2 It is your responsibility to hold valid travel documents (passport, visa, permits, health certificates) as required for your travel. We accept no liability for your failure to obtain required documentation.
5.3 You must comply with the rules and conditions of all suppliers. Failure to do so may result in denial of service or cancellation with no refund.
5.4 You are responsible for ensuring you are medically and physically fit to participate in the travel arrangement, and for any special requests (e.g., dietary, mobility). Such requests must be notified to us in writing at the time of booking, and while we will attempt to arrange them, we accept no liability if they cannot be met.

6. Web Site Use

6.1 Use of our website is subject to separate website terms (if applicable) and these Terms.
6.2 All materials on the website (content, images, text, logos) are protected by copyright and other intellectual property rights. You may use them for personal non-commercial use only.
6.3 Links to external websites are provided for convenience. We do not endorse or assume responsibility for external website content.

7. Changes or Cancellation by Us

7.1 We reserve the right to modify or cancel your booking or any part of the services if, for example, there is insufficient demand, airline schedule changes, force majeure, or supplier issues.
7.2 If we make a “significant change” (e.g., change of destination, major reduction in standard of accommodation, change in departure time of more than 12 hours) we will notify you as soon as possible and offer you the choice of:

  • accepting the changed arrangements; or
  • cancelling with a full refund of all monies paid.
    7.3 We will not pay compensation if the change or cancellation is due to “unavoidable and extraordinary circumstances” (events outside our control, e.g., war, natural disaster, epidemic, regulatory or airport closure).
    7.4 If the services cannot be provided as contracted and we offer an alternative of a lower standard, we will refund you the difference in value (if any).
    7.5 If any such change or cancellation occurs, the booking will terminate and we will refund all monies paid or applicable portion thereof as soon as reasonably practicable. Our liability will be limited to this refund.

8. Cancellation by You

8.1 You must notify us in writing (email acceptable) if you wish to cancel your booking. The date of cancellation is the date on which we receive your written notification.
8.2 Cancellation charges will apply depending on how far in advance you cancel (see your confirmation for the applicable charges). All costs we incur from suppliers and costs of administration will be borne by you.
8.3 If you do not show up at the commencement of services, or fail to meet schedule/time limits, you will be treated as having cancelled and no refund will be due.
8.4 Travel insurance, optional extras and other third-party services may be non-refundable. You should check with the supplier.

9. Alterations by You

9.1 If you wish to change any part of your booking (names, dates, room type, etc.) you must notify us in writing. We will endeavour to accommodate your request but cannot guarantee. Administrative charges, and any additional costs (change in supplier cost, currency difference) will be your responsibility.
9.2 Once your booking has commenced, no changes may be made.

10. Limitations of Liability & Indemnity

10.1 Asia Explore JSC acts as an agent for suppliers and is not responsible for omissions or acts of any supplier. We shall not be liable for any act, omission, failure or change of any supplier (including airlines, hotels, tour operators).
10.2 Our liability to you is limited to the amount paid by you for the booking. We shall not be liable for any indirect or consequential loss, or for any loss caused by you, or by circumstances beyond our reasonable control.
10.3 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud.
10.4 You agree to indemnify us against any liability, loss, damage, cost or expense we incur as a result of your negligent or reckless acts or omissions, breach of these Terms or failure to pay monies due.

11. Force Majeure / Unavoidable and Extraordinary Circumstances

11.1 “Unavoidable and Extraordinary Circumstances” means any event which we or the supplier could not foresee or avoid, including but not limited to war, threat of war, terrorist activity, civil unrest, natural disasters, fire, flood, epidemic/pandemic, closure or congestion of airports or ports, cancellation or rescheduling of services by authorities, industrial action or similar.
11.2 We will not be liable for failure or delay in performing our obligations caused by such circumstances and we may cancel or vary services without liability to you (apart from refund of unused services if applicable).

12. Travel Insurance

We strongly recommend that you obtain comprehensive travel insurance covering cancellation, personal injury, illness, death, baggage and other risks. You must ensure that such insurance is in place at the time of booking.

13. Health & Safety

You are responsible for ensuring that you are medically fit for the activities you undertake. We reserve the right to refuse to carry any person whom we believe to be unfit or whose participation may endanger other travellers.

14. Passport, Visa & Immigration Requirements

14.1 It is your responsibility to ensure that you hold a valid passport, visa (if required), and meet any immigration, health or other requirements for all destinations included in your booking.
14.2 We accept no liability if you are refused entry, deported or required to pay fines because you fail to meet such requirements.

15. Behaviour

15.1 You agree to behave in a responsible manner and comply with all rules, regulations and instructions of suppliers.
15.2 If you behave in a manner that is likely to endanger health or safety, or that causes annoyance or damage, we reserve the right to terminate the services of that person(s) without liability and you will remain liable for the cost of the booking.

16. Complaints & Disputes

16.1 Please contact us promptly with any complaint in writing within 30 days of return from your travel (or from the date the service was provided).
16.2 We will endeavour to respond within a reasonable timeframe.
16.3 These Terms shall be governed by and construed in accordance with the laws of [Insert jurisdiction, e.g., Vietnam / the country of incorporation]. The courts of [Insert jurisdiction] shall have exclusive jurisdiction (unless otherwise required by law).

17. Intellectual Property

All trade marks, service marks, logos, names and content on our website are our or our licensors’ property. You may not reproduce, adapt, distribute or publicly display them without our prior written consent.

18. Third-Party Links & Content

Our site may contain links to third-party websites. We do not control and are not responsible for their content, privacy practices or availability. Inclusion of any link does not imply endorsement.

19. Entire Agreement

These Terms, together with your booking confirmation and any special conditions notified by us at the time of booking, constitute the entire agreement between you and Asia Explore JSC and supersede any prior representation, warranty or understanding.

20. Severability

If any provision of these Terms is held invalid or unenforceable, that provision shall be struck out and the remaining provisions shall continue in full force and effect.

21. Changes to Terms

We may revise these Terms at any time. The version published on our website at the time of booking will apply to your booking.
